{"id":678,"date":"2017-05-07T16:02:12","date_gmt":"2017-05-07T16:02:12","guid":{"rendered":"http:\/\/statutes.org.uk\/site\/?page_id=678"},"modified":"2022-12-07T10:26:25","modified_gmt":"2022-12-07T10:26:25","slug":"1817-57-george-3-c-52-deserted-tenements-act","status":"publish","type":"page","link":"https:\/\/statutes.org.uk\/site\/the-statutes\/nineteenth-century\/1817-57-george-3-c-52-deserted-tenements-act\/","title":{"rendered":"1817: 57 George 3 c.52: Deserted Tenements Act"},"content":{"rendered":"<h3>1817: 57 George 3 c.52:\u00a0 An Act to alter an Act passed in the eleventh year of the reign of King George the Second, for the more effectual securing the payment of rents, and preventing frauds by tenants.<\/h3>\n<p>[27th June 1817]<\/p>\n<p>WHEREAS by an Act of Parliament pa<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>ed in the Eleventh Year of the Reign of His late Maje<span class=\"typographic-long-s\">s<\/span>ty King <i>George<\/i> the Second,<\/p>\n<p>[11 G. 2. c. 19. \u00a716.]<\/p>\n<p>intituled <i>An Act for the more effectual <span class=\"typographic-long-s\">s<\/span>ecuring the Payment of Rents, and preventing Frauds by Tenants<\/i>, it is amongst other Things enacted, that from and after the Twenty-fourth Day of <i>June<\/i> One thou<span class=\"typographic-long-s\">s<\/span>and <span class=\"typographic-long-s\">s<\/span>even hundred and thirty-eight, if any Tenant holding any Lands, Tenements, or Hereditaments at a Rack Rent, or wherethe Rent re<span class=\"typographic-long-s\">s<\/span>erved <span class=\"typographic-long-s\">s<\/span>hould be full Three-fourths of the Yearly Value of the demi<span class=\"typographic-long-s\">s<\/span>ed Premi<span class=\"typographic-long-s\">s<\/span>es, who <span class=\"typographic-long-s\">s<\/span>hould be in Arrear for One Year&#8217;s Rent, <span class=\"typographic-long-s\">s<\/span>hould de<span class=\"typographic-long-s\">s<\/span>ert the demi<span class=\"typographic-long-s\">s<\/span>ed Premi<span class=\"typographic-long-s\">s<\/span>es, and leave the <span class=\"typographic-long-s\">s<\/span>ame uncultivated or unoccupied, <span class=\"typographic-long-s\">s<\/span>o as no <span class=\"typographic-long-s\">s<\/span>ufficient Di<span class=\"typographic-long-s\">s<\/span>tre<span class=\"typographic-long-s\">s<\/span>s could be had to countervail the Arrears of Rent, it <span class=\"typographic-long-s\">s<\/span>hould and might be lawful to and for Two or more Ju<span class=\"typographic-long-s\">s<\/span>tices of the Peace of the County, Riding, Divi<span class=\"typographic-long-s\">s<\/span>ion, or Place (having no Intere<span class=\"typographic-long-s\">s<\/span>t in the demi<span class=\"typographic-long-s\">s<\/span>ed Premi<span class=\"typographic-long-s\">s<\/span>es), at the Reque<span class=\"typographic-long-s\">s<\/span>t of the Le<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>or or Landlord, Le<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>ors or Landlords, or his, her, or their Bailiff or Receiver, to go upon and view the <span class=\"typographic-long-s\">s<\/span>ame, and to affix or cau<span class=\"typographic-long-s\">s<\/span>e to be affixed on the mo<span class=\"typographic-long-s\">s<\/span>t notorious Part of the Premi<span class=\"typographic-long-s\">s<\/span>es Notice in Writing what Day (at the Di<span class=\"typographic-long-s\">s<\/span>tance of Fourteen Days at lea<span class=\"typographic-long-s\">s<\/span>t) they would return to take a Second View thereof; and if upon <span class=\"typographic-long-s\">s<\/span>uch Second View the Tenant, or <span class=\"typographic-long-s\">s<\/span>ome Per<span class=\"typographic-long-s\">s<\/span>on on his or her Behalf, <span class=\"typographic-long-s\">s<\/span>hould not appear and pay the Rent in Arrear, or there <span class=\"typographic-long-s\">s<\/span>hould not be <span class=\"typographic-long-s\">s<\/span>ufficient Di<span class=\"typographic-long-s\">s<\/span>tre<span class=\"typographic-long-s\">s<\/span>s upon the Premi<span class=\"typographic-long-s\">s<\/span>es, then the <span class=\"typographic-long-s\">s<\/span>aid <span id=\"2\" class=\"pagenum ws-pagenum\" title=\"Page:Deserted_Tenements_Act_1817(ukpga_18170052_en).pdf\/2\" data-page-number=\"2\"><\/span>Ju<span class=\"typographic-long-s\">s<\/span>tices might put the Landlord or Landlords, Le<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>or or Le<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>ors, into the Po<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>e<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>ion of the <span class=\"typographic-long-s\">s<\/span>aid demi<span class=\"typographic-long-s\">s<\/span>ed Premi<span class=\"typographic-long-s\">s<\/span>es; and the Lea<span class=\"typographic-long-s\">s<\/span>e thereof to <span class=\"typographic-long-s\">s<\/span>uch Tenant, as to any Demi<span class=\"typographic-long-s\">s<\/span>e therein contained only, <span class=\"typographic-long-s\">s<\/span>hould from thenceforth become void: And whereas it is expedient, for the due Protection of the Intere<span class=\"typographic-long-s\">s<\/span>t of Landlords, that <span class=\"typographic-long-s\">s<\/span>o much of the Paid Act as requires a Tenant to be in Arrear for One Year&#8217;s Rent <span class=\"typographic-long-s\">s<\/span>hould be altered, and that the Provi<span class=\"typographic-long-s\">s<\/span>ions of the <span class=\"typographic-long-s\">s<\/span>aid Act <span class=\"typographic-long-s\">s<\/span>hould be extended to Tenancies where no Right of Entry in ca<span class=\"typographic-long-s\">s<\/span>e of Non-payment is re<span class=\"typographic-long-s\">s<\/span>erved to the Landlord; be it therefore enacted by the King&#8217;s mo<span class=\"typographic-long-s\">s<\/span>t Excellent Maje<span class=\"typographic-long-s\">s<\/span>ty,, by and with the Advice and Con<span class=\"typographic-long-s\">s<\/span>ent of the Lords Spiritual and Temporal, and Commons, in this pre<span class=\"typographic-long-s\">s<\/span>ent Parliament a<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>embled, and by the Authority of the same,<\/p>\n<p>[Extended to Tenants in Arrear for One Half Year&#8217;s Rent instead of One Year.]<\/p>\n<p>That from and after the pa<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>ing of this Act of the Provi<span class=\"typographic-long-s\">s<\/span>ions, Powers, and Remedies by the <span class=\"typographic-long-s\">s<\/span>aid recited Act given to Le<span class=\"typographic-long-s\">s<\/span><span class=\"typographic-long-s\">s<\/span>ors and Landlords in ca<span class=\"typographic-long-s\">s<\/span>e of any Tenant de<span class=\"typographic-long-s\">s<\/span>erting the demi<span class=\"typographic-long-s\">s<\/span>ed Premi<span class=\"typographic-long-s\">s<\/span>es, and leaving the <span class=\"typographic-long-s\">s<\/span>ame uncultivated or unoccupied, <span class=\"typographic-long-s\">s<\/span>o as no <span class=\"typographic-long-s\">s<\/span>ufficient Di<span class=\"typographic-long-s\">s<\/span>tre<span class=\"typographic-long-s\">s<\/span>s can be had to countervail the Arrears of Rent, <span class=\"typographic-long-s\">s<\/span>hall be extended to the Ca<span class=\"typographic-long-s\">s<\/span>e of Tenants holding any, Lands, Tenements, or Hereditaments at a Rack Rent, or where the Rent re<span class=\"typographic-long-s\">s<\/span>erved <span class=\"typographic-long-s\">s<\/span>hall be full Three Fourths of the Yearly Value Year&#8217;s Rent of the demi<span class=\"typographic-long-s\">s<\/span>ed Premi<span class=\"typographic-long-s\">s<\/span>es, and who <span class=\"typographic-long-s\">s<\/span>hall be in Arrear for One Half Year&#8217;s Rent (in<span class=\"typographic-long-s\">s<\/span>tead of for One Year, as in the <span class=\"typographic-long-s\">s<\/span>aid recited Act is provided and enacted), and who <span class=\"typographic-long-s\">s<\/span>hall hold <span class=\"typographic-long-s\">s<\/span>uch Lands and Tenements or Hereditaments under any Demi<span class=\"typographic-long-s\">s<\/span>e or Agreement either written or verbal, and although no Right or Power of Re-entry be re<span class=\"typographic-long-s\">s<\/span>erved or given to the Landlord in ca<span class=\"typographic-long-s\">s<\/span>e of Non-payment of Rent, who <span class=\"typographic-long-s\">s<\/span>hall be in Arrear for One Half Year&#8217;s Rent, in<span class=\"typographic-long-s\">s<\/span>tead of for One Year, as in the <span class=\"typographic-long-s\">s<\/span>aid recited Act is provided and enacted.<\/p>\n<p>Source: <a href=\"https:\/\/books.google.co.uk\/books?id=ft4BxiUBdxgC&amp;pg=PA181#v=onepage&amp;q&amp;f=false\">The Statutes of the United Kingdom, 1817<\/a>.
